By requesting service, approving an estimate, paying a deposit, paying an invoice, or clicking "I Agree," you accept these Terms & Conditions. These terms govern all diagnostics, installation, repair, rigging, fabrication, parts sales, and related services performed by Salty Wire LLC (the "Company").
1) Quotes, Approvals & Change Orders
Estimates are not guarantees. Diagnostics may reveal additional parts/labor. We will seek your approval for material changes where practicable; emergency safety fixes may be performed to protect people/vessel. Photos/notes may be taken for records and quality control.
2) Payment Terms
• Due on request / upon receipt: All invoices are due in full when presented unless otherwise stated in writing.
• Deposits: We may require a deposit or full prepayment for special-order parts, custom materials, or third-party services.
• Checks by mail: If you mail a check, allow 7 calendar days for delivery and processing. Payment is not deemed received until funds clear.
• NSF/returned checks: A returned-check service charge of up to $30 (or the maximum allowed by law) will apply, in addition to collection costs.
• Late balances: Past-due amounts may accrue a finance charge of 1.5% per month (18% APR) or the maximum lawful rate, whichever is lower, plus reasonable collection and attorney's fees.
3) Card Payments - Pre-Dispute Resolution & Authorization
Authorization: You authorize Salty Wire LLC to charge your card for approved work, parts, taxes/fees, and any additional amounts you approve verbally, electronically, or in writing (including follow-up charges to correct underpayments or add approved items).
Pre-dispute process (required): Before initiating any credit/debit card dispute or chargeback, you agree to (a) email billing@saltywiremarine.com with a written description of the issue, (b) provide photos/logs reasonable to evaluate the claim, and (c) allow 10 business days for Salty Wire to investigate and cure. This clause applies to the fullest extent permitted by card-network rules and applicable law. Cardholders retain certain dispute rights under federal law and network rules.
4) Title, Risk, & Customer-Supplied Parts
• Risk during testing: You authorize sea trials/operational tests and accept normal test-related risks (weather, navigation, marina hazards). We are not liable for pre-existing defects or hidden conditions.
• Customer-supplied parts: No warranty or liability for customer-furnished components; additional labor/diagnostics caused by faulty or incompatible parts is billable.
5) Storage, Abandonment & Possessory Liens (South Carolina)
Storage: Storage fees accrue when a vessel/equipment remains after notice of completion or when work is paused awaiting your authorization/parts, at our posted daily rates.
Repair/Storage Lien: Under South Carolina law, a repair or storage facility has a possessory lien on an "article," which includes watercraft, for charges due. After statutory notices, a magistrate may authorize a public sale if amounts remain unpaid; proceeds are applied to charges and any remainder handled per statute.
Ship/Vessel Mechanic's Lien: Separately, persons furnishing labor/materials to construct, repair, or equip a ship or vessel in South Carolina may claim a lien on the vessel, tackle, and furniture, with a 90-day filing window and court enforcement/attachment procedures. Salty Wire LLC reserves these rights.
Non-payment notice: If you do not pay on request, we may retain possession and pursue lien enforcement, including sale, as permitted by law. You remain liable for any deficiency plus costs/fees.
6) Warranties & Returns
• Workmanship: Covered only as expressly stated in Salty Wire's written warranties (e.g., Electrical or Decking). Otherwise services are provided "AS IS."
• Products: Manufacturer warranties govern parts/components; claims are handled per manufacturer policies (Garmin handled as authorized dealer when applicable).
• No implied warranties: To the fullest extent permitted by law, ALL IMPLIED WARRANTIES ARE DISCLAIMED (including merchantability/fitness) except where prohibited.
7) Customer Responsibilities
• Accuracy & access: Provide accurate information, safe access, and timely authorizations. Remove valuables; we are not responsible for unsecured personal property.
• Environmental conditions: Marine environments cause corrosion and wear; you are responsible for normal maintenance, battery health, and power-management issues.
8) Limitation of Liability
NO CONSEQUENTIAL DAMAGES: Salty Wire LLC is not liable for incidental, indirect, special, punitive, or consequential losses (including downtime, loss of use, lost catches/charters, or diminished value).
CAP: Our total liability for any claim is limited to the lesser of (a) the amount you paid for the specific service/part giving rise to the claim, or (b) $1,000, excluding willful misconduct or bodily injury where such limitation is prohibited.
Indemnity: You agree to indemnify and hold Salty Wire LLC harmless from third-party claims arising from your misuse, alterations, or operating the vessel contrary to instructions/law.
9) Data, Device Fingerprinting & E-Sign Consent
Fraud prevention & records: You consent to our collection and use of anti-fraud & operational data, which may include device identifiers, IP address, approximate location, timestamps/clickstream, and session logs, consistent with our Privacy Policy and applicable law.
Electronic acceptance: You agree that clicking to accept, e-signing, or paying electronically constitutes your signature and agreement. Electronic records and signatures carry legal effect under the U.S. ESIGN Act and South Carolina's UETA.
10) Dispute Resolution, Venue & Attorney's Fees
Good-faith resolution first: The parties will attempt to resolve disputes in good faith, including the pre-dispute card process above.
Arbitration: Except for small-claims matters or lien enforcement/collection actions, any dispute will be resolved by binding arbitration under the Federal Arbitration Act and the rules of a recognized forum (e.g., AAA). Class actions and class arbitrations are waived to the extent permitted by law.
Venue & law: South Carolina law governs. Venue for court proceedings (including lien enforcement/collection) lies in the county where Salty Wire LLC maintains its principal place of business or where the vessel is located for lien purposes.
Fees: The prevailing party in any collection action may recover reasonable attorney's fees and costs as allowed by law and these Terms.
11) Force Majeure
We are not liable for delays or failures caused by events beyond our reasonable control (weather, supply-chain, labor, transport, regulatory actions, utilities, or similar events).
12) Entire Agreement; Updates
These Terms, together with any signed work authorizations, estimates, and the posted warranties, constitute the entire agreement and supersede prior discussions. We may update these Terms prospectively by posting the current version on our website.
SERVICE TEXT MESSAGING TERMS
Salty Wire Marine's text messaging program provides service/customer-care messages. Messages may include appointment or scheduling updates, service or project updates, estimate or Customer Document links, payment-request or receipt notices, and responses to your service questions. Promotional or marketing messages are not part of this program.
Enrollment requires your separate consent. By opting in, you authorize Salty Wire Marine to send service-related text messages to the mobile number you provide. Consent is not a condition of purchase. Message frequency varies based on your service activity. Message and data rates may apply.
Reply STOP to opt out at any time. We may send one final message confirming your opt-out. Reply HELP for help or email info@saltywiremarine.com. If you opt out and later want to receive messages again, you must provide new consent.
Wireless carriers are not liable for delayed or undelivered messages. Message delivery is not guaranteed and may be affected by your device, wireless service, or network conditions.
